Acceptable Use Policy
Introduction

Sports Impact is an Internet-based telephone system provided globally by Global E. The nature of the Internet is a freely-available communications medium which allows anyone with the necessary equipment to access the global network from their locale. As such, its use as a  communications medium brings certain responsibilities to Sports Impact users which Global E intends to enforce as a key aspect of its offering the service. This policy lays out those responsibilities and describes how they are enforced for the Sports Impact service. The principles behind this Acceptable Use Policy are based on those valid or prevalent in the European Economic Community but are intended to apply globally.

Application of the policy

Global E believes in applying this policy fairly. A fundamental aim of the Sports Impact service is to provide reasonably, quality communications to users within the Sportsbase community. In doing so, Global E feels it has an obligation to ensure the service is used in a fair, non-discriminatory way. Hence, the first stipulation of this policy is that Global E applies it globally and equitably, avoiding its use as a punitive system for users who may criticise or question Global E and/or the Sports Impact service, where such criticism is offered in a non-offensive, legal, constructive and honest fashion.

General Use

The central rule of the Sports Impact service is that users may not use it in any way that is unlawful or illegal. Equally they should not attempt to use the service in a fashion which affects the enjoyment of the service by other users of Sports Impact. The Sports Impact service may NOT be used directly or indirectly to:

  • Transmit, link to, provide access to, publish, advertise or otherwise to send material which is offensive, obscene, defamatory, indecent, racist, harmful, threatening or menacing.

  • Breach the rights of another individual including copyright, breach of confidence, privacy or other individual rights.

  • Procure, promote, associate with or otherwise influence an individual to commit a criminal offence

  • Circumvent or otherwise breach the acceptable use policies, terms and conditions or other legal obligations published by or on behalf of parent, connecting, associated or related networks

  • Breach the standards of the Advertising Standards Authority (UK), the rules and guidelines of the Office of Communications (UK), professional publishing standards, general Internet standards, and any local rules and regulations relating to Internet use in the territories in which the Sports Impact users access the service.

  • Infringe upon the rights of any person’s domain name, copyright, trade mark or name in statute or common law

  • Attempt to adversely influence the performance or normal operation of any other computer system or network

  • Exceed the volume and frequency of use limits indicated below

Privacy / Identity

Sports Impact requires users of Sports Impact to respect the privacy of other Sports Impact users. This means that it is unacceptable for Sports Impact users to:

  • Use the Sports Impact Directory to make unsolicited contact with other Sports Impact users for commercial gain

  • Use the Sports Impact service or directory in breach of local or international Data Protection legislation

  • Collect names and personal details of other users of the Sports Impact service, other than for personal use and with their permission

  • Impersonate someone else

  • Continue to call / contact a Sports Impact user where the called user has asked for such communication to cease

  • Use the service in such a fashion as to fabricate the number from which they are calling telephone users in order to mask their identity or, again, impersonate another individual (also known as “CLI spoofing”)

Capacity abuse

Sports Impact is generally provided as a ‘paid-for’ service that provides voice communications to, principally, home users of the Internet. Hence, Global E expects users of Sports Impact to use it in such a way as to maximise the available capacity for all other users. This means that people who use the service excessively may be deemed as breaching this Acceptable Use Policy. For the avoidance of doubt, Global E considers excessive use as:

  • Connecting a Private or Public Automated Branch Exchange to Sports Impact without permission

  • Re-selling Sports Impact communications capacity without permission

  • Making more than one voice call at a time (except conferencing)

  • Using devices designed to distribute the Sports Impact service to more than one user at a time

  • Using any Sports Impact facility to contact more than one party simultaneously, except as part of a conference facility, Sports Impact email facility, SMS broadcast or other facility provided as a feature of a Sports Impact service. This precludes the use of the same Sports Impact user making simultaneous, party-to-party, phone calls.

(except in the case of Sports Impact email facilities where any email to more than 50 recipients is considered excessive and in breach of the ‘General Use’ stipulations above)

Actions

Where any Sports Impact user has been deemed by Global E to have breached these conditions then Global E or its agents will contact that user with a request that they desist. In exceptional circumstances, Global E may elect to summarily suspend or terminate their use of the Sports Impact service.

Global E may, at its absolute discretion, release user details to the appropriate authorities if it feels necessary. Global E will always release such data where legally required.

Global E reserves the right to temporarily or permanently bar any user from access to the Sports Impact service if, in the opinion of an employee of Global E, the conditions, stipulations or intentions of this Acceptable Use Policy have been breached by that user. A barring of service to a user will result in any credit on their Sports Impact account being returned to that user by Global E after the deduction of an administrative fee (refer to the Sports Impact Rates of Service details for the latest administrative fee figure).

END.
